(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: 1 Director will conduct personal rights training with staff and submit proof to LPA Tillery. interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met, evidenced by: Staff and children interviews confirmed that Staff #3 has thrown a bouncy ball at the children and sprayed children in the face with a water bottle 8

This requirement was not met, evidenced by: LPA observed napping children to be barricated by card board boxes, which 1 Administrator agrees that staff will no longer use the card board boxes and will communicate with staff of the importance of supervision. (19) All food shall be protected against contamination. Contaminated food shall be discarded immediately. This requirement was not met, evidenced by: LPA observed molded food in the fridge and expired dry foods in the pantry. 1 Administrator and Floating Director will go through all foods to ensure molded and expired foods are discarded. Administrator and Floating Director will come up with a schedule for the kitchen while they look to hire a new cook. Administrator will send proof of kitchen schedule to LPA Tillery.
