Pennsylvania daycare ratios: how many children per staff person
In a Pennsylvania child care center, one staff person may care for at most 4 infants, 5 young toddlers, 6 older toddlers, 10 preschoolers, 12 young school-age children or 15 older school-age children, and every age level has a maximum group size. Here is the state’s chart and how often centers break it.

Source: 55 Pa. Code §3270.51 (ratios and group sizes for children of similar ages) and §3270.4 (age definitions). When ages are mixed, the youngest child’s age sets the ratio (§3270.52). At nap time the ratio is one staff person for 10 young toddlers, 12 older toddlers or 20 preschoolers (§3270.55), and at least two adults must always be present when two or more children are in care (§3270.54). Group and family child care homes follow other chapters.
How often Pennsylvania centers break ratio rules
Since August 2021, Pennsylvania has cited certified centers under its ratio rules (§§3270.51–3270.55) 2,421 times at 1,330 centers. It cited the “supervised at all times” rule (§3270.113(a)) another 4,054 times.
| Rule | Topic (the state’s wording) | Citations | Centers cited |
|---|---|---|---|
| §3270.52 | Mixed Age Level | 866 | 620 |
| §3270.51 | Similar Age Level | 849 | 610 |
| §3270.54(a) | Two facility persons present in facility | 191 | 167 |
| §3270.51/3270.52 | Similar Age Level/Mixed Age Level | 120 | 103 |
| §3270.52/3270.113(a)(2) | Mixed Age Level/Supervision on and facility premises | 66 | 51 |
| §3270.55(a) | Toddler and preschool children | 49 | 46 |
| §3270.51/3270.113(a)(1) | Similar Age Level/Staff assigned to specific children | 34 | 32 |
| §3270.51/3270.113(a)(2) | Similar Age Level/Supervision on and facility premises | 34 | 32 |
Every center page on Daycare Record labels these citations “Staff ratios.” Counts from Pennsylvania Department of Human Services inspection records; a violation re-cited at a follow-up visit counts once.
Why ratios matter
Fewer children per adult means closer supervision and more attention for each child. It is also why infant care costs the most: a room of 8 babies needs two staff, while one staff person can care for 10 preschoolers. Common questions
What is the infant ratio in Pennsylvania daycare centers?
One staff person for every 4 infants (birth to 1 year), in groups of no more than 8 (55 Pa. Code §3270.51).
What is the toddler ratio in Pennsylvania?
One staff person for every 5 young toddlers (1 to 2 years), in groups of up to 10, and one for every 6 older toddlers (2 to 3 years), in groups of up to 12.
What is the preschool ratio in Pennsylvania?
One staff person for every 10 preschool children (3 years until kindergarten), in groups of up to 20.
What are the school-age ratios?
One staff person for every 12 young school-age children (kindergarten through 3rd grade), in groups of up to 24, and one for every 15 older school-age children (4th grade through 15), in groups of up to 30.
Are ratios different at nap time?
Yes, for toddlers and preschoolers. During nap time Pennsylvania allows one staff person for every 10 young toddlers, 12 older toddlers or 20 preschool children (55 Pa. Code §3270.55). So a nap room can legally have fewer adults than the same room at play.
Can one adult be alone with the children?
No. At least two facility persons must be present whenever two or more children are in care, and on outings, and at least one of them must be a staff person (55 Pa. Code §3270.54).
What if the group has children of different ages?
The age of the youngest child in the group sets the ratio and the group size (55 Pa. Code §3270.52). A group with one infant follows the infant ratio.
How do I know if a daycare follows the ratios?
Count the children and adults in your child’s room when you visit (remembering the lower nap-time ratios), ask how the room is staffed at opening and closing, and check the center’s page on Daycare Record for “Staff ratios” citations. Since August 2021, Pennsylvania has cited certified centers 2,421 times under its ratio rules.
