LPA Hernandez’s observed a key lockable device that was not at least 60 inches above the ground. LPA also observed a vertical clearance of more than 2 inches from the ground to the bottom of the safe closing gate door. This poses a potential risk to the health, safety, or personal rights of children in care.

Based on observation, interview, and record review, the licensee did not comply with the section cited above. LPA and Director both reviewed children's sign in sheets. Upon reviewing 5 preschool children and 1 infant child were not signed in which poses a potential health, safety or personal rights risk to persons in care.

interviews. Interviews revealed that staff #1 was turned away tending to another child and was approximately 30-35 ft away from child #1 who was on the play structure when he/she obtained an injury. No staff was near the play structure supervising children.This poses a potential risk to the health, safety and personal rights risk to the children in care. Director stated she would provide proof of the training (signed training agenda and signed video transcript) to the Department by POC date 11/21/2023.

LPA's provided licensee with online Department resources (ccld.ca.gov) where Director could use informational videos on staff/child ratio regulations for training. staff interview and record review. Interviws and record review revealed that on 11/2/2023 that staff #1 was supervising 17 children in the play yard alone. This poses a potential risk to the health, safety and or personal rights of children in care. 8 Director stated she would provide proof of the training (signed training agenda and signed video transcript) to the Department by POC date 11/21/2023.

(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. 1 Director will ensure to not allow children in care to utilize staff restroom at any moment and will ensure to maintain visual supervision at all times. Based on statements provided by staff the facility violated the personal rights to child in care. This is a potential health and safety risk to children in care. 8
