(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain. 1 Site Supervisor Implemented steps to support the teacher. Such as, review personal rights policies, providing training on problem solving, and redirecting. Evidence was not met by: Assistant Teacher engaged in physical contact with child. Teacher grabbed the child by the hand and arm tightly resulting in a bruise. LPA obtain photos, and copies of facility investigation. 8 Supervisor stated they understand the personal rights regulations and will make sure staff obtain the proper training. POC CLEARED 7/8/26
(f) The licensee shall comply with all terms and conditions set forth in the admission agreement. This requirement was not met as evidence by: 1 Director stated she will review AB 2806 and review Catalyst resources on proper procedures for behavior. Based on interviews and record review, Staff 1 (S1) was left alone with children in care. Staff 1 is not a qualified teacher as they do not have ECE units. This poses an immediate health and safety risk to children in care.
Based on observation, the licensee did not comply with the section cited above due to the spiral slide being in disrepair, which poses/posed a potential health, safety or personal rights risk to persons in care.
