101216.3(b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. (1) A ratio of one fully qualified teacher (as specified in Section 101216.1(c)) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d). 1 Facility will provide proof of completion of the POC by February 27, 2026. Facility will ensure that they will be able to verify that a fully qualified teacher is overseeing and instructing each group of children and aide. This requirement is not met as by: Based on interviews, observations, and review of pertinent documentation. (A) Health-screening records and results of tuberculosis tests as specified in Section 101216(g). 1 The facility will email the LIC 503 Health Screening including TB test results and an immunization record for the new employee. Based on staff file review LPA observed that the facility failed to comply with the section cited above. 8

(e) In centers where the licensee chooses to handle medications: (1) All prescription and nonprescription medications shall be centrally stored in accordance with the requirements specified below: (A) Medications shall be kept in a safe place inaccessible to children. Move the medication to an area inaccessible to children. Based on observation the facility failed to comply with the section cited above, since LPA observed medication in an area accessible to children. 8 LPA observed that the medication was moved to an area inaccessible to children during the visit.

(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. 1 The facility will provide proof of vaccination for or immunity to the measles for the staff member by email. LPA observed that the facility has continued to fail to comply with the regulation cited above. 8

Based on file review, LPA was unable to verify the qualifications of the staff this violates the personal rights of children in care. 8 The facility immediately brought in a fully qualified teacher to be in ratio. The facility will continue using verified qualified staff while working to obtain verification of qualifications for the staff present today, that LPA was unable to verify.
