(a) The licensee shall provide care and supervision as necessary to meet the children's needs. 101229(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidence by: 1 Center has agreed to submit a written statement on how similar incidents will be prevented in the future. Director states she will be talking to all staff. LPA recommends staff watch videos on the CCLD website regarding Supervising Children in Centers. Based on LPAs observation, interview, record review, the licensee did not comply with the section cited above as two children were not under visual observation at all times which posed a potential health, safety or personal rights risk to persons in care. 8
(a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as S3 taunted children in care as evidenced written declarations of srtaff provided to the 1 Licensee to provided a written outline/plan to CCLD to eliminate the occurrence of any staff member taunting children in care. Written outline/plan to be provided to CCLD (elvin.baddley@dss.ca.gov) by 10/6/2023, by the close of business. CCC's Administration in February of 2023. (14) All persons engaged in food preparation and service shall observe personal hygiene and food- service sanitation practices that protect food from contamination. This requirement was not met as S3 sampled/ate the food of children in care, which was brought Licensee to provided a written outline/plan to CCLD to eliminate the occurrence of any staff member sampling/eating the food of children in care. Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1)...(C) Any unusual incident... that threatens the physical or emotional health or safety of any child. This requirement was not met as Director/CCC staff failed to report an unusual incident to 1 Licensee to submit a written outline to CCLD (elvin.baddley@dss.ca.gov) by 10/6/23, noting the process by which unusual incident reports will be reported to CCLD. CCLD pertaining to S3 sampling/eating children in care food from home and S3 taunting children in care. This poses a potential health, safety or personal rights risk to persons in care. 8
C1 being disenrolled from the CCC shortly after the parent of C1's noticing law enforcement/ CCLD of physical abuse/mistreatment at the CCC, which poses a potential health, safety or personal rights risk to persons in care.
(a) The licensee shall ensure that each child is accorded the following personal rights:... (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature...This requirement was not met as 1 Licensee to provided a written outline/plan to CCLD to eliminate the occurrence of any staff member mistreating or physically abusing children in care. Written outline/plan to be provided to CCLD (elvin.baddley@dss.ca.gov) by 9/8/2023, by the close of business. evidence of S3 physically abusing and mistreating C1 and C2 at the CCC, as documented by S1 and S2. This poses an immediate health, safety or personal rights risks to persons in care. 8
Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.The items specified in (d)(1)(A) through (H) above shall 1 Licensee to provided a written outline/plan to CCLD noting how reporting requirements will be adhere to.
