Also, the children's files did not have the receipts of the Acknowlegment of Receipt of Licensing Reports (LIC9224) which poses a potential health, safety or personal rights risk to persons in care.

This requirement has not been met as 1 The licensee's representative agreed to have all staff write statements regarding their understanding of personal rights and other Licensing regulations, and submit the ones that were present on the day of the incident, to Licensing by 9/1/22. Staff are on a break until late August 2022. evidenced by the review of video on 7/13/22, in which it was observed that a staff member grabbed, poked and slapped a child and other staff did not intervene. This poses a potential risk to the health and safety of children in care. 8 Failure to correct will result in $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.

This requirement has not be met as evidenced 1 The licensee's representative agreed to review information regarding Guardian and the process to associate and verify associations, and to submit a statement, by 9/1/22, to Licensing confirming their understanding of the process. Staff are on a break until late August 2022. by review of Guardian, and a discussion with staff during the office visit on 7/13/22. It was determined that a criminal record clearance for I. Artemieva was not associated to the facility prior to her working in the facility in August 2021. This poses a potential risk to the health and safety of children in care. 8 Failure to correct will result in $100 per day civil penalty until corrected. (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. POC- FACILITY HAS ALREADY TERMINATED THE EMPLOYMENT OF THE STAFF MEMBER. FACILITY WILL ALSO CONDUCT AN ALL STAFF TRAINING ON PERSONAL RIGHTS AND HOW TO DEAL WITH DIFFICULT CHILDEN. FACILITY WILL SUBMIT PROOF OF ALL STAFF TRAINING BY 6/3/22. FACILITY HAS BEEN NOTIFIED THAT THERE MAY BE AN INFORMAL CONFERENCE WITH CCL MANAGEMENT TO DISCUSS THE INCIDENT.

a) Each licensee or applicant shall furnish to the Department reports as required by the Department including, but not limited to, the following: (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (D) Any suspected physical or psychological abuse of any child. FACILITY SHALL ENSURE THAT ANY UNUSUAL INCIDENT THAT OCCURS AT THE FACILITY AND IN THE PRESENCE OF CHILDREN IN CARE SHALL BE REPORTED TO COMMUNITY CARE LICENSING BY PHONE WITHIN 24 HOURS OF THE INCIDENT AND SUBMIT THE UNUSUAL INCIDENT REPORT WITHIN 7 DAYS.
