(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater 1 The facility will continue to have the water shut-off to the Kindergarten Room Sink Faucet and keep the sign indicating that water is not for consumption. The licensee will have the Kindergarten Room Sink Faucet removed and submit proof of removal to the Department by April 21, 2023. shall be deemed an Action Level Exceedance. This requirement was not met as evidence by: Lead testing results showed that one (1) water sources has an action level exceedance which poses a potential health and safety risk to persons in care. 8

Based on record review, the licensee did not comply with the section cited above in 5 out of 7 records reviewed which poses/posed a potential health, safety or personal rights risk to persons in care. 5 staff (S1, S3, S5, S6, and S7) did not have record of infleunza vaccination, 2 staff (S1 and S3) did not have record of immunization against pertussis, and 1 staff (S3) did not have record of immunization against measles.

Based on record review, the licensee did not comply with the section cited above in 6 out of 7 records (S1, S3, S4, S5, S6, and S7) which poses/posed a potential health, safety or personal rights risk to persons in care.
