101238.2Outdoor Activity Space (b) The outdoor activity space shall be situated to:(1) Provide a shaded rest area for the children. This requirement is not met as evidence by: 1 Facility removed caution tape that surrounds the shaded sandbox area so children have access to the shade. LPA observed umbrella tables that were installed to provide shade to children while outside. Based on observations and interview the facility did not comply with the section above by ensuring all children are provided with a shaded area while outside, which is a potential risk to health, safety, and personal rights of children in care. 8
Licensee shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. This requirement is not met as evidence by: 1 The facility indicated the fountain will be removed and a wall mounted bottle filler will be installed. By 10/06/2023 the facility will submit proof that the water fountain was removed. Based on interview and record review the licensee did not comply with the section cited above as outlet E Drinking Fountain Hall (Stair E) exceeded the acceptable amount of lead allowed in a child care center, which poses a potential Health and Safety risk to persons in care. 8
101215.1Child Care Center Directors Qualifications and Duties(m)A child care center director shall complete 16 hours of health and safety training if necessary pursuant to Health and Safety Code Section 1596.866. This requirement was not met as evidence by: 1 Director completed the Preventative Health and Safety training on 06/30/2023. By 07/21/2023 LPA will follow up with director regarding other required documents that are still needed. Based on interviews and record review, the licensee did not comply with the section cited above by ensuring the director has submitted all required documents and completed all required trainings and certifications needed for a new director. 8

Based on observation, interview, record review, the licensee did not comply with the section cited above by ensuring all staff have a current criminal record clearance and/or associated to the facility, which poses/posed a potential health, safety or personal rights risk to persons in care. LPA was able to associate 1 staff during the visit. 2 other staff need to redo their criminal record clearance.
(1) A licensed child day care center... constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. 1 By 07/28/2023 submit confirmation of appointment with a certified water sampler. The facility cleared the POC during the visit by showing confirmation of appointment scheduled for 07/12/2023. LPA will follow up with facility after testing is completed. This requirement is not met as evidence by: Based on interview and record review the facility did not comply with the section cited above by having the drinking water tested for lead contamination no later than 01/01/2023. 8
