Based on interview and record review, the facility did not comply with the section cited above. A child was left unattended and unsupervised, posing an immediate health, safety, or personal rights risk to children in care. A proof of attendance from all staff will be required. The proof of attendance must be submitted to the department. The director stated she will also have the half door installed with an additional safety feature to prevent future incidents.

101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met by: They will decide on that specific staff member as she is already on administrative leave. They will also train all staff on Personal Rights. Based on interviews, obtained information, and record review, the facility did not comply with the section cited above which poses a potential health, safety, or personal rights risk to children in care.
