(1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance.This requirement was not met as evidence by: Based on record review 1 The sink is located in a closed classroom. Classroom has been closed since 2020. Children do not have access to the classroom. LPA took pictures and cleared citiation during visit the facility did not ensure water sources at facility meet lead requirements. Lead test results showed that one water sources have an action level exceedance. LPA observed water sources are inaccessible to children. 8

Based on observation and interview, the licensee did not comply with the section cited above. At 9:30am, LPA observed in Room 2, 23 preschoolers with Staff 2 and Staff 2. Therefore, Room 2 was over ratio. Director had Staff 3 go into Room 4 with 7 preschoolers. which poses an immediate health, safety or personal rights risk to persons in care.

(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedence. 1 Per Director, the drinking fountain will be capped and the water faucet inside classroom three will be flushed and re tested. Director will submit pictures of the capped water fountain and the results of the tested water faucet inside classroom three. This requirement was not met as evidence by record review. Lead test results showed that two water sources had an action level exceedence of 7.8 and 5.5. This is a potential risk to the health and safety of the children in care. During the inspection, LPA observed both water sources were covered with a bag 8 making them inaccessible. The drinking fountain was also shut off.
