Based on observations/interviews/record reviews, the licensee did not ensure the personal rights of children in care in that 30 of children in care (C1 – C30) did not wear face coverings while in the facility, as required by the Order of the State Public Health Officer (June 11, 2021), and an individual face covering exception did not apply. This is a potential health and safety risk to children in care.

Personal Rights: The licensee shall ensure that each is accorded the following personal rights. To be accorded safe, healthful and comfortable accomodations, furnishings and equipment to meet his or her needs 1 Licensee stated that she will talk with staff about wearing masks and encourage them to wear a mask. This requirment was not met as evidence by: LPA Mendez's observation of all staff indoors not wearing masks as required. 8
