To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. 1 On or before 2/11/26, staff will be met with, retrained on positive guidance and interactions with children during classroom activities and transitions. At this time the staff member is not present at the center. Per Center Director, further coaching, training This requirement was not met as evidence by: a staff member was observed pulling a child in care by the back of his collar and proceeded to kick him at least 3 times while directing him to the carpet which posed an immediate risk to the health, safety, and personal rights to persons in care. 8 and modeling will take place on an ongoing basis. Director will submit proof of training to LPA Plumboy.

a staff member was observed frustrated with children in care and a child nearby went to run by the teacher, the teacher grabbed him with both hands by the back of his sweatshirt to get him to stop running which posed a potential risk to the health, safety, or personal rights to persons in care. 8 training videos, had a staff meeting, and reviewed their program OATH since the incident.

Based on the self-reported incident and interview, a child in care was walking around without one shoe, wet clothes, and wet socks. The staff were unable to find the child’s other shoe and the child had fallen and due to the rain and water outdoor, his clothing were wet. When the child’s parents arrived at the center, the child in care was missing one shoe, and left by staff in wet clothes, and wet socks for at least 5 minutes which poses an immediate health and safety risk to children in care. 8 Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.

Based on the interview and record review, the facility did not comly with the section cited above. Preschooler (C1) was left unattended in the playground which poses an immediate health and safety risk to children in care. 8 The facility shall submit the agenda, plan, and staff attendance to CCLD outlining how the facility and staff will always ensure the complete supervision of all children in care.

a staff member grabbed a child from the left arm and took him to the play dough table forcing child to walk and sit which posed a potential risk to the health, safety, or personal rights to persons in care. 8 acknowledging that they have watched the assigned training video and understand their responsibility to provide Personal Rights to children at all times. The facility representative will email this signed statement to LPA Plumboy no later than 5/10/2024 at 5:00 PM.
