101212 Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was net met by: 1 Director stated going forward she will make sure to report incident within 24 hours and submit a written UIR within seven days to CCLD. Based on the facility not reporting the incident regarding C1 injury and being unable to provide documentation showing the incident was reported to CCLD, this poses a potential safety risk to children in care. 8

(1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met by: 1 Director stated they have completed name to face training. Based on interviews, the licensee did not comply with the section cited above. Child #1 (C1) was left alone on 11/25/2024 without any adult supervision inside the restroom for approximately 8 to 10 minutes, which poses an immediate health, safety or personal rights risk to persons in care. 8

This requirement was not met by: 1 Director stated she has closed one classroom and going through the agency to hire more staff. Based on video recordings from 11/15/2024 showing 14 children with one staff inside classroom #121 and LPA observing 13 children with one staff on 11/19/2024 inside classrrom #117 the licensee did not comply with the section cited above, which poses an immediate health, safety or personal rights risk to persons in care. 8

Based on observation and interview, the licensee did not comply with the section cited above. 101161(a) Limitations on Capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. 1 Director moved the infant child back to infant license during LPAs' visit. Director stated that they will not move an infant to the preschool side without an exception from the department. Based on observation, interview, and record review, the licensee did not comply with the section cited above in that, one (1) infant was comingling in the preschool, which poses an immediate health, safety or personal rights risk to persons in care. 8

Supervision shall include visual observation. This requirement was not met by: 1 Director stated sometimes they are busy with other children on the playground. Director also stated they will place more staff inside the classroom. Based on staff interviews, the licensee did not comply with the section cited above. LPA interviewed six staff. Three out of six staff stated they have they have left children alone inside the classroom when they are assisting another child inside the restroom or changing a child. One staff stated they have witnessed a child being left on the play yard alone which poses an immediate health, safety or personal rights risk to persons in care. 8

This requirement was not met by: 1 Director stated they are combining the children if they can and bringing in more staff. Based on staff and parent interviews, the licensee did not comply with the section cited above. LPA interviewed six staff. Three out of six staff stated they have been out of ratio. Four out of six staff interviewed stated they have witnessed other staff being out of ratio. On 9/12/2024, LPA reviewed records where a teacher had informed the front office staff they were out of ratio. One out of the three parents interviewed stated they have observed one staff caring for 13 to 14 children alone in the morning during drop-off which poses an immediate health, safety or personal rights risk to persons in care. 8

On 3/25/22, LPA upon entrance into the 1 Facility representative Ms. Anffziger, Christina posted the Notice of Site visit issued on 3/18/2022. Facility Representative shall ensure the Notice of Site visit will be posted immediately uon receiving from Department personnel in future. facility observed the Notice of site visit was not posted by the facility representative issued on 3/18/2022. Civil penalty is being assessed for failure to post the Notice of Site visit. This is a potential risk to Health and Safety to the children in care. 8
