Personal Rights:(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as 1 Director Hollandsworth indicated that there was a miscommunication with how staff read the Whiteboard (where diapering protocol is provided). Therefore, the facility has color coded whiteboard for children in diapers and uses a color coded posted list for children who are potty training and potty trained. The list also has directions to remove pull up at 3:00pm which is the approximate time children who nap pull ups wake up from nap. evidenced by: Staff disclosure and June 26, 2023 incident report indicate the facility did not follow agreed potty training protocol on June 23, 2023. The preponderance of evidence indicates the incident resulted in child #1 having a dried soiled diaper discovered at home after pick up. 8 In addition staff now have their own list of children who they are responsible for which makes it more streamline.…

(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedence 1 LPA observed photos and today's visual evidence that the water fountains were completely removed. Therefore the item will be cleared as of 4/4/2023 email. This requirement was not met as evidence by record review. Lead test results revealed one accessible water source (and one future accessible) had an action level exceedence. This is a potential risk to the health and safety of the children in care.
