Responsibility for Providing Care and Supervision (a)(1) No child(ren) shall be left without the supervision of a teacher at any time.... Supervision shall include visual observation. This requirement is not met as evidence by: Assistant Director stated facility is providing staff training on Supervision Monday Oct. 9, 2023 and will provide LPA with staff sign in sheet by 10-20-23. Faciilty implemented name to face when docuemnting and counting children as they use CSR- Child Supervision Record for all classes. Based on LPA’s interviews, 6 out of 9 staff stated they witnessed child #1 (C1) left unattended on playground. This action poses an immediate risk to the health and safety to children in care.

(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement is not met as evidence by: 1 Director provided a written statement to LPA Duron, stating staff schedules will be adjusted for coverage. A staff meeting will be conducted on August 21, 2023 to cover ratios and operational expectations. Director will submit staff sign in sheet and agenda to LPA on Aug 22, 2023. This requirement is not met as evidence by: Based on LPA’s interviews with staff. 9 out of 10 staff stated facility is has been out of ratio. LPA reviewed Child Supervision Record (CSR) and confirmed that in preschool classroom at 8:37am, staff documented 14 children in care with 1 staff present. This action poses an immediate risk to the health and safety to the child in care. 8

Based on interviews with staff and children, and documentation gathered from the 1 The director stated that the staff #1 who violated the child #1's personal rights will no longer work at this facility. As of today's inspection, the facility has determined that this staff #1 will be transferred to a nearby Kindercare facility and complete a Positive Child Guidance Training. The director will also be addressing personal rights with all staff facility LPA determined that staff #1 aggressively grabbed a child by the arm, moved them to another part of the classroom against their will, and yelled at this child. This child became distraught, cried, and vomitted as result of these actions. This is an immediate threat to this child's health, safety, and personal rights. 8 at the facility. Proof of this meeting will be submitted to LPA once this has been completed. By 8/10/22, director will email LPA a plan for when this will be conducted and what will be covered.
