Based on observation, interview, and record review, the licensee did not comply with the section cited above as there is one fully qualified lead teacher and one fully qualified aide supervising 20 children making the facility out of ratio. There was an adittional staff with no ECE units present. This poses a potential health, safety or personal rights risk to persons in care.
101216.2: Teacher Aide Qualifications and Duties: (e) An aide shall work only under the direct supervision of a teacher. (1) An aide who is 18 years of age or older, and who meets the requirements of this section and Section 101216, may escort and/or assist children in going to the bathroom, and may supervise napping children as specified in Section 101230(c)(1), without being under the direct supervision of a teacher. This requirement is not met by: 1 Facility must ensure that teacher aides have proper documentation of educational units on file. Facility must ensure that an aide is working under the direct supervision of a fully qualified teacher. Based on observation and interview, the licensee did not comply with the section cited above as LPAs observed bottled cleaning solutions in arms reach of children and were not stored appropriately which poses/posed a potential health, safety or personal rights risk to persons in care.
Infant Care Discipline (b) Confinement to cribs, high chairs, playpens or other similar furniture or equipment shall not be permitted as a form of discipline or punishment. This requirement was not met as evidence: 1 Each child shall receive safe, healthful and comfortable accommodation. Based on the course of this investigation it has been determined that staff use inappropriate forms of punishment to discipline children. 8 Director agreed to host a training on Children's Personal Rights, document the meeting and send proof of meeting to Licensing. Also, submit a written discipline policy as well as describe how staff would deal with challenging behavior children.
Personal Rights (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidence: 1 Director must talk to staff and come up with a plan of correction. Proof of meeting must be sign by Director and staff. Based on the course of this investigation it has been determined staff yell at day care children. 8 Submit proof of meeting to the department by 05/03/2023
