Based on record review, the licensee did not comply with the section cited above by ensuring all staff have required immunization records in file, which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on observation, there was an infant sleeping in a high chair and unattended which poses an immediate risk to the health, safety, or personal rights of the chldren in care.

This requirement is not met as evidence by: By 04/14/2023 the director will submit a written plan on how they will maintain ratio, even when staff are out sick or on vacation. Based on interviews the facility did not ensure staff are operating within ratio at all times, which poses an immediate risk to the health, safety, and personal rights of children in care. 8
101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidence by: 1 By 04/14/2023 the director wil submit a written plan on how the facility will ensure they provide care and supervision to meet the children's needs. Based on interviews the facility did not ensure all staff are supervising the children properly to meet the children's needs, which poses an immediate risk to the health, safety, and personal rights of children in care. Staff indicated they are unable to adequately supervise the children, which is causing children to get hurt. 8
101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidence by; 1 Owner agrees to develop a written plan of action to ensure there are no future incident. A copy of the plan shall be sent to CCL by 2/10/23. Based on interviews it was confirmed that staff revealed confidential information. This is an potential risk to Health and Safety or Personal Rights risk to persons in care. 8 Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violation are $250 per violation and $100 per day until corrected.
101223 Personal Rights(a) The licensee shall ensure[..] (3)To be free from corporal or unusual punishment, infliction of pain,[..] This requirement is not met as evidence by; 1 Due 5/26/22 Director will submit to CCLD a written statement understanding the regulation of Personal Rights. Based on observation, interviews and record review it was confirmed that Child 1 did sustain unexplained injuries while in care.This is an immediate risk to Health and Safety or Personal Rights risk to persons in care. 8 By next week, Facility with conduct staff training/meeting on Personal Rights and Responsibilty for providing care and supervision. Facility will submit an agenda and a sign-in sheet of all staff present.
(f) The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative. This requirement is not met as evidence by; By 6/1/22 Director will submit a written statement understanding Licensing Reporting Requirements. Based on observation, interviews and record review so it was confirmed that Child 1 did sustain unexplained injuries while in care and it was not reported to parent.This is a potienal risk to Health and Safety or Personal Rights risk to persons in care. 8

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. REQUIREMENT WAS NOT MET: WHEN A CHILD WAS ABLE TO WALK OUT OF THE INFANT ROOM DURING MORNING CHECK IN AND WAS WITHOUT ADULT VISUAL SUPERVISION FOR 10 TO 15 SECONDS 1 PER OWNER ON 2/21/22 THE CENTER WAS CLOSED FOR THE DAY AND SHE HAD A STAFF MEETING AND HALF DAY OF TRAINING ON SAFETY MEASURES, INTAKE PROCEDURES, AND CHILD SUPERVISION. DUE TO THE NATURE OF THIS INCIDENT, A NON-COMPLIANCE CONFERENCE WILL BE SCHEDULED WITH COMMUNITY CARE LICENSING
