Type A 101216.2 (e) Qualifications and Duties (e) An aide shall work only under the direct supervision of a teacher. The director was given the opportunity to present a plan of action so the department can help the facility get back into compliance. The director stated and provided a declaration understanding when and how the deficiency occurred. This requirement was not met as evidence by records and statements. The director stated that she is aware that this is occurring due to limited staffing. This poses a potential risk to the children in care. 8 The director stated that she will provide a training on this regulation and moving forward stated on a declaration to stay in compliance of this regulations. 101700.3 California Lead Action Level at Child Care Centers (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. 1 The director will finish the 3 week flush that was initially started on 11/02/2022 and send flush documentation to LPAs email @ stella.gutierrez@dss.ca.gov by 11/22/2022. The director stated that there will be another sampling scheduled after 11/22/2022. Based on lab report analysis water from Outlet B (7.8 parts per billion) and same Outlet C (6 parts per billion) taken on 10/21/2022 indicate levels of lead in exceedance. 8

(1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. 1 Facility staff followed Written Directives in PIN 21-21 CCP for lead water testing. Licensing Forms 9275, 9276 and facility sketch was completed and submitted. Director stated outlets were fixed and will be retested as soon as posible. All outlets have signs stating "DO NOT USE" to maintain inaccessibility. Director agreed to provide documentation to LPA showing the sinks have been repaired and retested when it is completed. Based on lab report analysis water from Outlet B (7.8 parts per billion) and same Outlet C (6 parts per billion) taken on 08/25/2022 indicate levels of lead in exceedance. 8 Facility continues to use Brita filtered water from the other water outlets for the staff and children.
