Based on observation, facility did not comply with regulation in that there was a potted artichoke plant with small spikes accessible to children on the playground. This is a potential risk to the health and safety of children in care. 8 Mr Rios states he will communicate this information to Lead Teacher, Principal, and other staff.
Based on interviews with staff and self reported unusual incident, it was determined that a 4 year old child was found outside of elementary school premises approximately 67 yrds passed the school gates, without visual supervison from staff. This occured at pick up time while the main street where the child was found, was busy with traffic. This poses an immediate risk to the health, safety and personal rights of child in care.
Based on interview and documentation provided, facility failed to report an unusual incident to the department within 24 hrs via telephone. Incident ocurred on 2/05/25 and reported via phone on 2/07/25. This deficiency posed a potential risk to the health, safety and personal rights of children in care.
Based on interviews, licensee did not ensure that each parent that signed LIC 9224 was provided copy of the licensing report dated 05/08/24, which poses a potential Health, Safety, or Personal Rights risk to children in care.
… Principal stated she met with S1 and discussed personal rights of the child and held a meeting with parents and both teachers in the classroom regarding the incident. Principal also held individual trainings with staff members about how to report concerning incidents immediately and procedures to follow. Principal stated she would send documentation of the trainings with staff signature by 5/9/24 to LPA Lane via e-mail. Based upon numerous staff interviews and unusual incident reported to the Department from the facility, staff member (S1) restrained a child (C1) during lunch for over 20 minutes while the child was visibly upset which is an immediate health, safety and personal rights risk to children in care.
… 1 Both staff members were spoken to and staff have been advised to put any confrontational situations in writing and Principal is copied on it. Corrective measures have been taken to ensure it doesn't happen again. Based upon staff interviews, a verbal altercation occurred between staff members in front of parents and daycare children on 4/29/24 which is a potential health, safety and personal rights risk to children in care. Director also stated that the AM and PM programs going forward will have uniform procedures (gatekeeper procedure) to aid with communication between teachers and resolve conflicts. Principal stated she would send new procedures to LPA Lane via email by 5/9/24.
… Principal stated she has already addressed this violation, spoke with personnel on 2/26/24 in the classroom and corrected it. It has not happened again. Principal will send proof of meeting via e-mail to LPA Lane by 5/9/24 with staff signatures present. Based upon staff interviews, assistants were requested to do activities with groups of children outside the classroom without a qualified teacher numerous times which is a potential health, safety and personal rights risk to children in care.
