(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. 1 S4 was let go and no longer works at the facility. Facility to provide on the job training on personal rights. Agenda to be submitted to CCL with all staff signatures proving attendance by 11/24/23. This standard was not met as evidence by: S4 was observed pulling children's hair as a form of discapline. 8

(a)The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. 1 Facility director issued idividual staff meetings and staff were issued write-ups on 6/2/23. Staff are now required to count on the roll sheet and check each child off during every transition and a yard sweep in now mandatory. Director to submit a plan in writing to CCL by 6/6/23. This was not met as evidence by: based on interviews and record review, C1 was unsupervised for 30 minutes on the playground. This poses an immediate health, safety, or personal rights risk to persons in care. 8
Based on observations and interviews the licensee did not ensure the personal rights of children in care in that 28 children in care did not wear face coverings while in the facility, as required by the Order of the State Public Health Officer (June 11, 2021), and an individual face covering exception did not apply. This is a potential health and safety risk to children in care. on hand and the letter informing parents that the facility will comply with the mask mandate by 12/27/21.
based on video observations and interviews the safety of children in care was not ensured by S1 who improperly transported and roughly handled multiple children in care on 8/4/21 during nap time. 1 Licensee agrees to provide personal rights training, utilizing videos from the CCL website. The administration will also provide a written plan showing extra help will be provided to cover nap times and staff lunches. Completed training will include all staff signatures and statement of actions that will be taken to prevent future violations. Training to be completed and submitted to LPA by 9/24/21. This poses an immediate health, safety or personal rights risk to persons in care. A civil penalty of $250 applies for a repeat offense.
