101216 Personnel Requirements(i)Prior to employment or initial presence in the child care center, all employees and volunteers subject to a criminal record review shall: (1) Obtain a California clearance or a criminal record exemption as required by law or Department regulations This requirement was not met as evidence by: 1 Staff is to leave the facility immediately If out of ratio, Director is to bring in additional help that has already been cleared to be in their facility. Staff is to return only when they are fingerprint cleared and fully qualified. Based on LPAs observation, interview, record review, the licensee did not comply with the section cited above which 2 staff members did not have a criminal record clearance associated to the facility. 8

S1 caused 1 Child care center self reported the incident 10/11/2023. The incident occurred on 10/05/2023. S1 was terminated on 10/06/2023. S1 is no longer working in child care. Center will provide monthly staff training on child personal rights and submit agenda and signed attendance sheet to LPA for injury to child leaving a mark on hand. This poses an immediate risk to children in care. 8 a period of 3 months.
