Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights: (2)To be accorded safe, healthful and comfortable accommodations... (3)To be free from ..., infliction of pain, humiliation, intimidation... This requirement was not met as evidenced 1 Facility representative stated that a behavior modification plan will be set in place to address Child 1's behavior. Child 1 will not be in attendance until a meeting with the parents has occurred and the behavior modification plan has been agreed to. Another offense will result in gathered during the investigation shows that the facility failed to address continuing biting from Child 1, which posed/poses an immediate risk to the health and safety of children in care. This was corroborated by LPAs interviews with witnesses, file review, and documented evidence. 8 the child being sent home, a repeated offesne will result in the child being kept home for two days. Personal Rights.(a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as Facility is requireing all children to wear shoes before going to the playground. The facility has also got sewer caps to prevent possible injury. The facility has also developed procedures for staff to determine if conditions on the playground are safe or not for children. evidenced by the second degree burns C1 sustained on 05/10/2024, when they were allowed to walk on the playground barefoot. This posed and immediate risk to health, safety, or personal rights of children in care. 8
Based on record review, the licensee did not comply with the section cited above, as Staff #1 did not have current completion of the required Mandated Reporter Training, which poses a potential health, safety or personal rights risk to persons in care.
