101223 (a)(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature…, 1 Director ensured that all staff had the training to prevent personal rights violations. Facility director termiated the staff. LPA clear the deficiency during the visit and provided POC letter. Staff spoke to child in raised voice as child was not listening to staff, which posed an immediate risk to the health, safety, or personal rights of children in care. 8

(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. 1 During the complaint investigation, Assistant Director Martha Garcia viewed the "Reporting Requirements" video on the ccld.ca.gov website and discussed the video with LPA Plumboy This requirement was not met as evidence by: Based on interview and record review, the Director did not report the incident or law enforcement presence at the facility which poses a potential health and safety risk to children in care. 8 Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.
