The licensee shall ensure that each child is accorded the following personal rights, To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. 1 The Administrator shall review regulations and submit a letter outlining how this will be avoided in the future. The Administrator shall conduct a training on children's personal rights and how to ensure all children are treated with dignity and respect by the POC date. The LPA reviewed the classroom surveillance video, which clearly shows a teacher forcefully handling a child, which resulted in a child sustaining bruises, scratches, and abrasions. The items below shall be reported to the Department within 10 working days following their occurrence: Any change of the chief executive officer of a corporation, of the general partner(s) of a partnership, or of the controlling partners in a limited liability corporation. 1 Administrator John Mims and the Owner Barbara Moore shall submit all required licensing documents supporting any changes made to the license by the POC date. The facility remains out of compliance, as there is no documentation of who is currently designated as the responsible party for the License. Based on interviews with Barbara Moore and John Mims there has been a verbal agreement of partnership. Resulting in John Mims retaining the majority of the business. No person, firm, partnership, association, or corporation shall operate, establish, manage, conduct, or maintain a child day care facility in this state without a current valid license therefore as provided in this act. 1 The Administrator John Mims shall submit a plan outlining the what next steps will be taken moving forward. Mims will notify CCL in writing of what direction will be taken regarding obtaining a license by the POC date. During the course of a complaint investigation it was determined that the Licensee on record, Barbara Moore, no longer maintains control of property so the license is forfeited. The current operator, John Mims, has been served with a Notice of Operation in Violation of Law (NOVL).
