(1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. Based on observation the licensee did not comply with the section cited above in during inspection of the outside play area LPA observed a pile of wood that was almost as high as the outside fence and was accessible to children. LPA also observed rotten fruit on the ground, a garden that was not being maintained that could pose harm and/or threat to children. LPA also observed that tanbark needs to be added to the play structures to provide cushion under high areas. which poses/posed a potential health, safety or personal rights risk to persons in care.
