Based on interview and observation, the Site Director did not ensure that children are always supervised by a teacher as a toddler from the outside yard crawled through a broken fence and entered the preschool outside yard which poses an immediate risk to the health, safety, and personal rights of children in care. 8 The Site Director will implement new procedure/schedule for toddlers/preschoolers inside/outside play to maintain ratio of children and submit to the Department by 11/18/2022. Immediate $500 civil penalty assessed for lack of supervision.
Based on interview, observation, and record review, the Site Director did not obtain California clearance or criminal record exemption prior to employment or initial presence in the facility for 13 out of 15 staff hired in 2021/2022 which poses an immediate risk to the health, safety, and personal rights of children in care. 8 All due dates will be clearly outlined on the new hire packet and align with Title 22 CA Code of Regulations to be submitted to the Department by 11/18/2022. Civil penalty assessed for staff clearances.
Based on observation, record review, and interview, the Site Director did not follow the facility fire clearance and utilized an upstairs observation room that is not approved for day care use which poses a immediate risk to the health, safety, and personal rights of children in care. 8 A written declaration for planned use of the space should be submitted to the Department by 11/18/2022. Based on record review, interview, and observation, the Site Director did not conduct a disaster drill at least every six months for the preschool component during 2020-2021 which poses a potential risk to the health, safety, and personal rights of children in care. 8 A copy of scheduled dates for disaster drills at the child care center will be submitted by 11/18/2022 to ensure drills are conducted for all components. (If individual classrooms/components will participate, the schedule should reflect that.)
Based on observation and interview, the Site Director did not ensure exits were not blocked by children’s napping mats which poses a potential risk to the health, safety, and personal rights of children in care.
The Licensee will start the permitting process with Scotts Valley Building Department and submit proof by 11/4/2022. The facility will immediately cease use of the outdoor space until completed permits have been obtained. The Licensee did not obtain permits prior to construction of outdoor classroom coverage structures, which poses a potential risk to the health, safety, and personal rights of children in care. 8 Outdoor classroom should not be used until final permits are submitted for the structures.
