(a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule...or other actions of a punitive nature. This requirement is not me as evidence by: 1 Principal states S1 has not returned to facility. Principal agrees to meet with staff and review policy and procedures along with Personal Rights of children Regulation. Prinicipal agrees to send meeting agenda to LPA along with staff who participated in meeting. Based on interview, observation and record review, S1 handled C1 roughly in the play yard. C1 was held by S1, by one arm and by both arms limiting C1's ability to move freely which posed an immediate Health and Safety and Personal Right risk to children in care. 8

This requirement has not been met as evidence by: Principal agrees to inform LPA Lovest of any updates or course of action further taken by facility. Principal agrees to submit signed agenda to LPA from meeting regarding personal rights. Based on LPA’s interviews and record review facility staff engaged in verbal altercation, exchanging different words, in elevated volume in the presence of day care children, Which poses a potential personal rights, health or safety risk to children in care. 8

(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. Per Principal, plan of correction was to replace the bubbler and existing point of use filters. This requirement was not met as evidence by: Based on interviews and supportive documents, the facility did not comply with the section cited above in the water fountain located outside Room 3, identified on the facility sketch by letter “E”, tested at 10.3 bbp on 10/18/2022 exceeding allowable limit for lead which poses a potential Health, Safety or Personal Rights risk to persons in care. 8
