(B) No infant shall be forced to sleep, to stay awake or to stay in the designated sleeping area. 1 Disciplinary action for the staff member that violated the child's personal rights. Based on the facility's self report and interviews, the licensee did not comply with the section cited above when a staff used water to keep an infant awake, which violates the personal rights of the infant in care and poses a potential health or safety risk to persons in care. 8 The facility had already completed their plan of correction, prior to this citation being issued.
