Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidence by: Based on interviews and video 1 Per Site Supervisor, there were meetings held with all staff on 10/29/2024 and 11/01/2024 where appropriate handling of children was reviewed and personal rights were discussed. Site Supervisor provided LPAs with a copy of the meeting agenda and staff signatures of who attended. footage review, LPAs observed C1 being spun by S1 in video surveillance footage. S1 stated she spun C1 by her wrists while playing outside. Per S1 when transitioning inside, C1 stated her arm was hurting. C1 sustained a dislocated elbow. This poses an immediate health and safety risk for children in care. 8
