C1, C2, C3, were not accorded a safe and healthful environment as all 3 children obtained and ingested amphetamines and/or methamphetamines resulting in the serious 8 bodily injury (C1) – elevated heart rate – 132 [reference range 70 – 120], insomnia, abnormal hyperactivity, vomiting, constant movement, and non-stop talking; Child (C2) – abnormal hyperactivity; Child (C3) – seizure-like activity, behaviors/acting in a manner inconsistent with the child’s normal mannerisms, speech delay, looks “out of it”, staring off, tongue smacking, and fidgeting. This is an immediate risk to the health,safety, and personal rights of the children in care.

Responsibility for Providing Care and Supervision- The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time…Supervision shall include visual observation. This requirement is not met as 1 POC- Biohazard cleaning. Daily health checks and backpack checks done during drop off, signed by parents. Training on 6/27/24 for active supervision. evidenced by: The Facility failed to provide the care and supervision necessary to meet the children’s needs when children in the facility were left unsupervised, allowing the children ample time to obtain and ingest amphetamines and/or methamphetamines that were determined to be in the facility per 8 bio-hazard company testing completed on 5/31/24. C1, C2, C3, were clearly exhibiting signs of intoxication. This is an immediate risk to the health,safety, and personal rights of the children in care.

Licensee was made 8 aware of C3 symptoms on 05/31/24 and failed to report the next working day of 6/3/24. Sometime in the month of May 2024, S2 and S3 knew C2 was displaying symptoms, body slumped over with no strength, and this unusual incident was not reported to the department as required. This is an potential risk to the health, safety, and personal rights of the children in care.
