Based on observation, the licensee did not comply with the section cited above in that on two separate occasions a child went into the restroom unsupervised, which poses an immediate health, safety or personal rights risk to persons in care. On both occasions staff had to be notified a child was in the restroom at which point the staff moved to stand outside the restroom door to provide supervision.

Based on observation, the licensee did not comply with the section cited above in that a pesticide glue trap was accessible on the floor near classroom 1's entrance and exit door. The glue trap has a warning label that states "Keep Out of the Reach" of children. There were no children in the vicinity of the trap during the observation, therefore this is a Type B citation. However, the accessible trap poses a potential health, safety or personal rights risk to persons in care.

This requirement is not met as evidence by: 1 Facility will implement corrective action pursuant to section CCR 101704 for immediate cessation of outlets testing with action level exceedance until it is replaced and retested pursuant to section CCR 101705 and returns a result at or below the Acton level. Facility will notify CDSS with completion within 30 days. Based on records review of required lead testing, the facility had lead values of 5.5 or above on water outlets: Outlet B (33 ppb), and Outlet E (14 ppb). This is a potential health and safety risk to persons in care. 8 Lead water testing documents were submitted to CCL.

Based on interviews and records reviewed LPA discovered the facility had knowledge of confirmed cases of hand foot and mouth and only informed parents of one of three classrooms. Additionally Licensing was not informed. This poses a potential risk to the health and safety of children in care. 8 Facility Administrator will submit to licensing on or before the stated POC date of 11/23/2022 a statement of understanding of this regulation and written plan to meet their required reporting requirements.
