101226(a):...licensee shall immediately notify the child's authorized representative if the child... sustains an injury more serious ... licensee shall obtain specific instructions from authorized representative regarding action ...taken. 1 Licensee states discusssed reporting procedure with staff on 11/22/23 and reviewed ouch report policy and ccld website videos regarding reporting requirements and provided LIC624 to staff. Licensee provided LPA with training sign in sheet during the visit. Based on the information obtained during interviews, observations, and documentation reviewed it is determined that facility staff did not immediately report the injury of child 1 to responsible party which posed a potential health, safety, or personal rights risk to children in care. 8

ADMISSION AGREEMENTS: 101229(A): The licensee and the child's authorized representative shall jointly complete a current individual written admission agreement for the child. This documentation shall be maintained at the child care center and shall be available for review. 1 Licensee states facility uses a checklist for child documennt and will develop a plan to double check that all child files are complete and will train appropriate staff and will provide plan to LPA no later than close of business 12/15/23. Based on record review the Licensee did not comply with the regulation above as Child 1 has no admission agreement in file which poses a potential health, safety or personal rights risk to children in care. 8

SIGN IN AND SIGN OUT: The person who brings the child to, and removes the child from, the center shall sign the child in/out. 1 Licensee states facility will implement a new procedure for sign in/out that requires staff to hand clipboard to parents when children are signed in and out and staff will also record absences for children not present. Licensee will complete training and provide proof to LPA no later than close of business 12/15/23. Based on record review the Licensee did not comply with the regulation above as 6 of 11 children in classroom 4 were not signed inor out properly every day in September 2023 as required which poses a potential health, safety or personal rights risk to children in care. 8

(1(B) REPORTING REQUIREMENTS: upon the occurrence, a report shall be made to the Department by telephone or fax...next working day...during its normal business hours. In addition, written report... shall be submitted...within seven days following the occurrence... 1 Licensee states will submit incident report no later than close of business 10/20/23 and will review reporting requirements regulation, conduct staff training on incident reporting, and will in future report all unusual incidents timely. Based on interview & record review Licensee did not comply with regulation above as staff failed to report 9/22/23 incident wherein a CPs report was made regarding child 1 and not reported verbally within 24 hours/in writing in 7 days which poses a potential health, safety, or personal rights risk to children in care. 8

Commencing Sept. 1, 2016, a person shall not be employed or volunteer...if she has not been immunized against influenza, pertussis & measles. This requirement was not met as evidence by: 1 REPEAT VIOLATION. Mrs. Garcia stated that she will have staff Zynthia Acosta obtain her immunization record and will submit by 3/27/2023. Based on record review and Mrs. Garcia's statement, staff failed to provide a copy of her immunization as previously requested on 2/15/23. 8

Based on record review and statement by Mrs. Garcia, staff Hannah Aceves & Claudia Laevanos failed to obtain a health screening as previously requested on 2/15/23.

Based on observation, the licensee did not comply with the section cited above. LPA observed an epi-pen stored out of its original box (without the prescription, name of the child and instruction) This poses a potential health, safety or personal rights risk to persons in care.

Based on interview, the licensee did not comply with the section cited above. Mrs. Garcia stated that she has not obtain a lead study as required by AB 2370 which requires facility to test their water if building was constructed before January 1, 2010. This poses a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above as one staff (Zyntia Acosta) did not have a copy of immunization to indicate that she has been vaccinated against Pertussis and Measles. This poses a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above. Three staff did not have a current Mandated Reporter or has taken the wrong component. This poses a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above. Staff Hannah Aceves & Claudia Laevanos did not have a current Physician's report on file. This poses a potential health, safety or personal rights risk to persons in care.

Facility staff did not notify responsible party of daycare child's injury in a timely manner.
