101238.3 Indoor Activity Space(a)There shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity. This requirement was not met as evidence by: 1 Director moved three children from the smaller room into the bigger room. Based on LPAs observations and interview the licensee did not comply with the section cited above in 1 out of 1 records, room measurements are only to acomodate for 9 children at a time and 12 children were found to be in the room. 8

101212 Reporting Requirements(c)The licensee shall notify the Department in writing of his/her intent prior to making any structural changes that reduce the total amount of indoor or outdoor activity space. Such structural changes shall include, but not be limited to, room additions. This requirement was not met as evidence by: 1 Center is to submit an updated application (LIC200A), facility sketch, and report any changes to the Department by 09/06/2023. Based on LPA's observations and interview the Licensee did not comply with the section cited above as the Department was not made awarer of the room changes which caused a decrease in capacity. 8
