Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above, surfaceof the front play yard is in need of repair due tomultiple holes throughout the rubber surface and facility is in need of painting as there is chipped paint throughout the facility. LPA observed which poses/posed a potential health, safety or personal rights risk to persons in care.
101223(a)(3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidence by: 1 Director stated that the Rhino Room will be reopened and would return to classroom use beginning 8/15/2024. In the meantime, a door knob with a lock would be installed so the Rhino Room is inacessible from the restroom. Director will provide proof of corrections via emai to LPA. 101223(a)(2) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidence by: 1 Director agreed that a calming corner will be created in the classrooms with pillows and a soft rug so that children who are having difficult time can have an area where they can go to. Director will provide LPA with pictures of the calming corner has been created. Based on interviews and observations, child obtained bruising/mark on her nose from crying and rubbing their face on the napping equipment which poses a potential risk to the health and safety of children in care. 8
(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (D) Any suspected physical or psychological abuse of any child. The director will have an In-Service Training meeting within two weeks with the staff regarding personal rights and the process for handling children with behavior issues. This is evidenced by: The investigation revealed that Child #1 has been pulling other children's hair and other inappropriate behaviors that violate children's perrsonal rights. This is an immediate risk to the health and safety of children in care. 8
