101227: Food Services: " (a) In child care centers providing meals to children, the following shall apply:...Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20,...Requirements for Meals, for the age group served." This requirement is not met by evidence by: 1 LPA provided a printed copy of the regulations to director. Facility must rearrange meals to be able to meet the nutritional guidelines for each food component for the lunch meals that they serve. Based on interviews, observations, and record review, the facility did not comply with the section cited above as the facility is not meeting the nutritional guidelines for the amount of food components requirement for lunch meals based on age group. This poses a potential health, safety or personal rights risk to persons in care. 8 Facility must update their menu and submit a written plan on how each meal meets the nutritional guidelines and serving portions and it must be submitted to LPA Tapia-Mandujano by 8/28/26 via email.

This requirement is not being met as evidence by: 1 Staff member stepped back in to bring the classroom back into ratio. Based on observation, interview, and record review, the facility did not comply with the section cited above as upon LPAs arrival, there was one staff(S1) with 20 preschool age children, which poses a potential health, safety or personal rights risk to persons in care. 8 Facility must submit a written plan on how they will ensure that appropriate teacher to child ratios are met at all times, including on what steps to take when staff need to step out. Written plan must be submitted to LPA Tapia-Mandujano via email by 7/31/26. Civil penalties were assessed.

Based on observation, interview, and record review, the facility did not comply with the section cited above as when LPA was conducting physical plant inspection, there was one staff with 22 children and then one staff with 15 children which poses a potential health, safety or personal rights risk to persons in care. 8 Facility must submit a written plan on how they will ensure that appropriate teacher to child ratios are met at all times, including on what steps to take when children need to use the restroom. 101223: Personal Rights: " (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs." This requirement is not being met as evidence by: LPA had a conversation with both Director and Site Director about what was observed. Based on observation, the facility did not comply with the section cited above as LPA observed a child dozing off in a chair that is not appropriate equipment to sleep and a staff (S2) sitting on top of child's cot with a child in arms which is not safe. This poses a potential health, safety or personal rights risk to persons in care. 8 Facility will submit a written plan to acknowledge that incidents like these do not occur. Facility will also submit a written plan on how the facility will prevent incidents like these happening in the future. Written plan must be submitted to LPA Tapia-Mandujano via email by 5/22/26.
