Based on observation, half filled syringe with pink antibiotics in a clear zip lock bag was observed in a small refrigerator in preschool room 1B. Director identified the antibiotics is for child C4 then quickly took it away and said she will place in the "staff refrigerator" which poses an immediate health, safety or personal rights risk to persons in care.

Based on observation and interview with staff Nicolle Daniels, she initially stated she is no longer the Director due to legal before stating that she was still Director, of the facility but that new teacher wasn't slated to start until Monday. She was observed as the fully qualified teacher in room 1B supervising 2 aides and 17 children then around 12:30pm entered infant room when that qualified teacher exited. There was no Director in place during the visit which poses a potential health, safety or personal rights risk to persons in care.

101161(a) Limitations on Capacity - A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not meet by: 1 Director stated, School age children will go in the private school upstairs. Based on observation the unlicensed school age children were combined with the preschool classroom. Preschool Facility is licensed for children ages 2 to kindergarten age ONLY. Licensee stated there were children ages 4 – 8 in the classroom upon LPM and LPA arrival. This is an immediate risk to the health and safety of children in care. 8

101223 Personal Rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. 1 Director stated, all chidlren nap on cots now and expressed that the children sleeping without cots or mats was due to a former staff making the decision. Based on interviews, although the facility has enough napping cots/sleeping mats for all enrolled children, the facility has not made them available for use at all napping periods. On multiple occasions children have been placed on the carpet and hard floor to sleep without cots, floor mats, and sheets. 8

101216.1(b)(1)Teacher Qualifications and Duties - A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement...or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing. This requirement was not met by: 1 Director stated, a fully qualified teacher has been hired, fingerprints are cleared, and will be starting on 8/18/22. Based on interview, observation, and records review, classroom 1D (2's) had an aide and volunteer caring for 7 children but not a qualified teacher. Therefor the classroom is out of ratio. This is a potential risk to the health and safety of children in care. 8
