101229(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision... (1) No child(ren) shall be left without the supervision of a teacher... Supervision shall include visual observation. This requirement was not met: Director stated since the incident happened they make sure there is a staff present and supervising the dance class, if they are short staff then the dance class will be cancelled for the day. Director will submit a written plan of correction to licensing office by 7/12/23. Based on interviews conducted, Staff were not visually supervising C1 or any of the children while they were in dance class with A1. This poses potential Health and Safety risk to children in care. 8

In addition...(1) Events reported shall include the following: (B) Any injury to any child that requires medical treatment. This requirement was not met: Director stated they will submit the written LIC624 unsual incident report of the incident to licensing office by 7/12/23. Director will make sure to report any unusual incidents to licensing within 24 hours of occurance and a written report within 7 days to licensing office. LPA provided a copy of regulations. Based on interviews conducted with S1. S1 was not aware and did not report the incident to the licensing department within 24 hours and submit the incident report withing 7 days. This poses a potential health and safety to the childcare children. 8

Based on observation, interview, and record review, the facility did not comply with the section cited above. While touring the facility LPA Observed staff #1 caring for children inside the Preschool Classroom. Staff #1 stated she has been working at Tutor Time for approximately 2-3 months. Director stated Staff #1 started working at the facility on April 4, 2022 which poses an immediate health, safety or personal rights risk to persons in care.

101700.3 California Lead Action Level at Child Care Centers (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. 1 Director made sinks inside the kitchen and Toddler 2 classroom inoperable by means of tape the reads "Do Not Use." Director stated the sink are being repaired today by a plumbing company called Tech One. Director agreed to provide documentation to LPA showing the sinks have been repaired. . Based on lab report analysis water from faucet E (17.500 parts per billion) and faucet R (13.800 parts per billion). These faucets samples taken on 07/28/2022 indicate levels of lead in exceedance. 8 Brita filtered water pitchers from the other PASS sinks readily available for the staff and children.

Based on information obtained from interviews with staff and parents, LPA 1 The correction to this violation was discussed with both director Michelle Amaral and District Manager Miriam Keramati. The facility has put forth corrections to return the facility to compliance with ratio Regulation. These corrections the facility has made include increasing hourly pay, hirign bonuses to new applicants, regularly contacting 3rd party has determined that around drop off times, about 2 to 4 days a week in the morning teachers are supervising more than 12 preschool children at one time for 5 to 15 minutes at one time. This presents an immediate health and safety risk to children in care. 8 substitute vendors, and communicating with parents about staff and necessity for facility to always remain within compliance of 1 teacher to 12 children ratio, at all times. A detailed plan of these corrections will be emailed to LPA Valencia on 3/23/22.

101223(a)(2) Personal Rights The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful, and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidence by. 1 Director states she will continued to send out communication to the families and post something different in their lobby regarding the requirement masks for children ages 2 and older. During today's visit it was observed that the Director had extra masks for children at the front and children have their mask on. Director will email the communication to LPA Nguyen by 11/05/21. Based on LPA observations, document reviews and interviews which were conducted. Most facility children did not wear face coverings while in the facility as required by the CA Dept. of Public Health Guidance. This is a potential risk to the health and safety of children in care. 8
