Based on observation, the licensee did not comply with the section cited above in which poses/posed a potential health, safety or personal rights risk to persons in care. LPA Garcia observed a push gate that was not able to close or lock and was slightly open upon inspection. LPA attempted to close the gate, but it would not close or lock, staying slightly ajar and making the gate accessible for children to exit the play yard and enter the head start play yard.

(b) Testing results with fractional ppb readings of 5.5 ppb shall be deemed an Action Level Exceedance...This requirement was not met by evidence by 1 Facility will remove water fountains and sumbit a picture by email to Palmdale regional Office by due date. base on interview and record review ALE results containing lead in drinking water fountain F, I, and K which is out of compliance with the allowable ALE of 5.5 ppb. This poses a potential health and safety risk to the children in care.
