Through IB investigation, documents and interviews revealed, C47 was not provided healthull accomodations when C47 injured their wrist.

Based on LPAs' observations, interviews, and documents collected during the investigation, LPA received statements from staff and parents describing the violation of perosnal rights of children, in particularly multiple statements revealed, a red mark wa sobserved on C3 cheek. 8 All the staff who attend the meeting will signed statement, in order to confirm their understanding of chidlrens personal rights. Any form of discipline or punishment that violates a child's personal rights as specified in Section 101223 shall not be permitted regardless of authorized representative consent or authorization. 1 Licensee stated she disagrees with the findings, will submit documentartions of a meeting with staff . order to review certain practices that shall not be permitted in this facility. The staff wil sign a discipline policy and the policy will be emailed to German. Negrete@dss.ca.gov LPAs utilized photo that was taken of C3 as part as evidence to this investigation. Also former staff stated S3 would harm children in care. Additionally the department received statements from a parent and former staff, alleging S3 took away lunch as a form of punishment. 8
Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be accorded dignity in his/her personal relationships with staff and other persons. To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. 1 Correct Immediately. Please submit a written plan of correction to the Department for review by 01/17/2025. This requirement was not met based on documents collected and interviews with the witnesses who stated they observed staff #3 inappropriately restrain a child and heard staff #3 make inappropriate intimidating statements to children in care. 8
Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such 1 The preschool needs to call the OD line and report the incident that occured on 03/27/2024 and incident that occured on 5/17/2024. Also Director needs to submit a written incident report to the department unusual incident email UnusualIncidentReportsDO17@dss.ca.gov This requirement was not met based on documents collected and interview with the staff who stated there was a incident on 3/27/2024, between C#3 and C#4. Documents collected revealed a incident on 5/17/2024, when C#15 was able to exit the the preschool through an open gate. Staff did stop C#15 at the bench. 8

The parent of C#4 was not made aware of the incident when it occurred and was provided ouch report on 4/18/2024 which is signed by parent dated 4/18/2024. 8

This plan will outline how the facility will stay in compliance with teacher to child ratio. document review for 04/16/2024, 04/18/2024, and 5/10/2024, the preschool was found to be out of ratio compliance. 8
&b In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following: (1) The person who signs the child in/out shall use his/her full legal signature and shall record the time of day. (b) The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirement was not met by: 1 Please submit a plan of correction to Licensing by 07/22/2024 to Licensing to ensure this violation is not repeated. Based on interviews with staff and record review: revealed 3/2024, (15 days)and 04/2024 (7 days) child #3 was not signed out by parent/staff or resonsible individual when child was picked up by bus. 4/18/2024, child #2 was not signed out by parent/guardian. 7/12/2024, child #18 did not have parent/guardian signature/or time when child arrived. Child #46 did not indicate the time the child was picked up by parent/guardian.
Based on interviews conducted with staff and parents revealed staff #7 was observed to inappropriately handle and speak to child #1. It was also found at least 3 children were not provided enough snack & at times would eat the crackers from the ground. One of the staff told the lead staff to give the children more.
Based on record review of Parent Handbook 2023-2024, parent interviews, and staff interviews revealed the center has not met the above requirement: 8 CCR
101216.3 (b) Teacher-Child Ratio: The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. This requirement was not met by: 1 Please correct imedately. Submit a written plan to ensure this violation is not repeated. Based on interviews of staff and record review: On 04/12/2024, it was found there was one teacher and two aides supervising up to 25 children on the playground when child #1 became aggressive with child #2. The two aides seperated child #1 and #2. The teacher on duty provided comfort to child #2. 8
Site visits; posting of notices; contents; citations for violations; duration of posting; civil penalties The notice posted pursuant to subdivision (a) shall remain posted for 30 consecutive days, except that a FDCH shall comply with the posting requirements contained in this subdivision only during the hours when clients are present. 1 The Notice of Site Visit was posted today during the inspection. Please submit a written plan to ensure the Notice of Site Visits are posted as required, including the Parent Board. This requirement was not met due to the observation, inspection, and interview with Director, revealed the failure to post the Notice of Site Visit for the required 30 days for visit conducted on 04/10/2024. 8

Director will read title 22 CCR 101161(a) and email any questions to LPA pertaining to this regulation. If the director has no questions then the drirector will email LPA stating she fully understand the regulation. german.negrete@dss.ca.gov This requirement was not met due to LPA conducting staff and director interviews pertaining to(C5) enrollement, file records, and emails with director verifying that C5 is an infant and should not be enrolled or be receiving care and supervision at this facility. 8
The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1)... Supervision shall include visual observation. 1 Please submit a written plan by 03/15/2024 of how staff will meet the needs of the children. via email german.negrete@dss.ca.gov This requirement was not met due to LPAs and staff#2 observed child#1 unattended in the restroom. Staff #2 acknowledge they were unaware Child#1 was alone without supervision. LPAs observed staff#1 conducting housekeeping duties in the art room while children were not directly supervised while napping in the main room. 8

The licensee shall ensure that each child has an individual permanent or portable storage space for his/her clothing, personal belongings and/or bedding.... 1 CCC will build or purchase cubbies and apropriate stoage equipment that will suffice the regulation. LPAs observed children's jackets, personal belongings piled on top of a bench. LPAs did not observe appropriate storage/cubbies for children's personal belongings. 8
