101170 Criminal Record Clearance: (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department...This requirement was not met as evidence by: The director uploaded the required documents for Perla Lopez Zurita and associated her to the facility in the Guardian background data system at the time of inspection. Miss Lopez Perla left the facility. The director understands that Miss Lopez Perla is not to work in the facility until her criminal record clearance has been obtained. Based on record review and observation, staff member Perla Lopez Zurita does not have a criminal record clearance and was not associated to the facility on 10/3/22, at the time of inspection. This poses an immediate health and safety risk to the children in care. 8
Based on interviews and record reviews, Staff #4, though enrolled in classes at the time, was assisting the preschool classroom teachers with 10 minute breaks while still an Aide and prior to completing the full six units required to directly supervise children. This is a potential hazard to the health and safety of children in care.
