(a)In child care centers providing meals to children, the following shall apply: Commercial foods shall be approved by appropriate federal, state and local authorities. All foods shall be selected, transported, stored, prepared and served so as to be free from contamination and spoilage and shall be fit for human consumption……… This requirement is not met as evidence by: Staff will remove the gallons of expired milk and staff will undergo retraining on the provision of adequate food service for children in care. Staff will provide a copy of the attendance sheet for staff training. Based on observation and confidential interviews, the facility did not comply with the section cited above by providing expired milk for daycare children which posed a potential Health, Safety or Personal Rights risk to persons in care. 8

This requirement is not met as evidence by: Director/staff will provide written statement on how to maintain safe play equipment for day care children. Based on observation, the facility did not comply with the section cited above when the facility provided play equipment with a broken window that has sharp edges which posed a potential Health, Safety or Personal Rights risk to persons in care. 8

Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above by allowing Staff 1, 2, and 3 to yell at children in care when providing guidance and direction in the classroom that caused children undue emotional discomfort as they cried and became saddened by the staff’s behavior which poses an immediate health, safety or personal rights risk to persons in care.
