101227 Food Services(a) In child care centers providing meals to children, the following shall apply: (8) Commercial foods shall be approved by appropriate federal, state and local authorities. All foods shall be selected, transported, stored, prepared and served so as to be free from contamination and spoilage and shall be fit for human consumption……. This requirement is not met as evidence by: Staff will remove the gallons of expired milk and staff will undergo retraining on the provision of adequate food service for children in care. Staff will provide a copy of the attendance sheet for staff training. Based on observation and confidential interviews, the facility did not comply with the section cited above by providing expired milk for daycare children which posed a potential Health, Safety or Personal Rights risk to persons in care. 8
