Based on observation, interview, and record review, the facility did not comply with the section cited above in that the facility was not documenting 15 mintue sleep checks, which poses/posed a potential health, safety or personal rights risk to children in care.

Based on observation, interview, and record review, the facility did not comply with the section cited above in that prescription and nonprescripition medication was not dated or labeled with children's name which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, interview, and record review, the facility did not comply with the section cited above in that several children were not signed into the facility which poses/posed a potential health, safety or personal rights risk to children in care.

Based on observation, interview, and record review, the facility did not comply with the section cited above in that children 12 months and under did not have a LIC9227 on file, which poses/posed a potential health, safety or personal rights risk to children in care.

Based on observation, the facility did not comply with the section cited above in that, the LPA observed the Preschool Room(Room3) to have 26 children, when maximum licensed capacity is 23 children. This poses/posed a potential health, safety or personal rights risk to children in care.

Correction has been made. LPA provided cpoy of regualtion. Director will provide a written statement stating she understands the regulation. Correction will be sent to LPA Annette.Sutherland@dss.ca.gov by 3/27/25.. Facility disclosed confidential information of children in care which poses a potential health, safety and personal rights risk to children in care.

Correction has been made and parents were provided a copy of childs file. Based upon interviews, the facility, denied the parent access to Child #1's file upon disenrollment. This is a potential risk to the health and safety of children in care.

1596.857(b) Rights of parent or guardian...No child day care facility shall discriminate or retaliate against any child or parent or guardian on the basis or for the reason that the parent or guardian...has lodged a complaint with the department against a facility. 1 Director was advised a parent can't be retaliated against for making complaints against the day-care. LPA printed out regulation. Director will submit a statement stating she understands the regulation. Director will send statement to LPA via Annette.Sutherland@dss.ca.gov Based on the information obtained during interviews and documentation reviewed it is determined that facility retaliated against child’s authorized representative for allegedly making a complaint to California Licensing Department and stating in an email to the facility. 8
