Based on observation, interview, and record reviews, the licensee did not comply with the section cited above. At 1:15 pm, during staff file reviews and interview, 5 out of 5 stafff members did not have their current mandated reporter training certificate, which poses a potential health, safety or personal rights risk to persons in care.
101229(a)(1) Responsibility for Providing Care & Supervision: No child(ren) shall be left without the supervision of a teacher at any time.... Supervision shall include visual observation. This requirement is not met by: 1 The Director will look to additional resources and will prensent at the staff meeting on April 17, 2025. Director will send the agenda to LPA by April 18, 2025. Based on observation, interviews, and medical records review, staff who were present at the playground did not provide adequate supervision: did not see/prevent C2 kicking C1, causing C1 to be injured. This poses a potential risk to the health, safety, and person rights of the children in care.
101223(a)(2)(3) Personal Rights: The licensee shall ensure that each child is accorded the personal rights in this section. (2) To be accorded safe, healthful, and comfortable accommodations… (3) To be free from…infliction of pain. The licensee did not meet the requirement above: 1 The school staff sought prefessional help from external resources agencies. It was ultimately decided that the child's needs were better served at a different educational institutions to which the child was referred. The child enrolled in the new school in March. Based on interviews and records review, the licensee did not meet the regulation, which posed/poses an immediate risk to the safety and personal rights of clients. C1 hurt other children & touched them inappropriately while in care. Incidents' dates range from 10/2023 to 2/2024.. 8
Based on records review and interviews, the director did not have a current roster of children in care during the unannounced visit. The director has class rosters without the required information that would appear in the LIC9040.
