(b) All children shall be given an opportunity to nap or rest without distraction or disturbance from other activities at the center. (1) A napping space and a cot or mat shall be available for each child under the age of five. This requirement was not met as evidence by: 1 Facility will create a schedule that includes a rest time and send a picture of schedule to LPA by POC date. Based on observation and interview the facility did not comply with the regulation by not having a rest time provided without distraction and disturbances and not having mats available for the children under age 5. This is considered a potential health, safety, or personal rights risk to children in care. 8

Based on interview the previously designated on site director was no longer employed at the facility. A new designated director was not reported to department. This is considered a potential health, safety, or personal rights risk to children in care.
