Limitations on Capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidence by: The facility had 95 children present when the overall capacity is 93 children. This poses 1 Assistant director sent home two children to have the facility in compliance. an immediate health and safety risk for children in care. 8

Based on the interviews and information obtained Facility did not have operable toilets for the staff and children . Children had to walk to the different facility located in the different address to use the restrooms . 8
