Based on interviews, the licensee did not comply with the section cited above. During the investigation, LPA conducted interviews, and it was confirmed that staff member yelled at and handled a daycare child in a rough manner. This poses a potential health, safety, and personal rights risk to children in care. 8 Personal Rights in Child Care” and submit written proof to the Fresno Regional Office, including the names of staff who reviewed the video and the date of completion. Licensee agrees to be referred to the Technical Support Program (TSP).

Based on interviews and records review, licensee did not comply with the section cited above, as it was confirmed that Child #1 (C1) entered the classroom without adult supervision and remained inside the classroom unsupervised until a daycare parent found C1 alone. This poses an immediate risk to the health, safety, and personal rights of children in care. 8 with the site supervisor monitoring and verifying the census count every 30 minutes; and documentation of additional safety measures that will be implemented to ensure classroom doors remain closed and secured at all times, with staff assigned to monitor the doors.

a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Based on interviews, the licensee did not comply with the section cited above. Facility representatives had submitted written proof of protocols to LPA that they implemented protocols of ensuring that daycare children are being release to the correct authorized representative. Facility representative will need to submit written proof to the Department by 06/17/2025 indicating that all staff members have been trained on the new protocol. During the case management inspection, it was confirmed that staff members failed to ensure that a daycare child was released to the right authorized representative. As staff discovered that the child was released to the wrong authorized representative, staff went after the authorized representative and observed that the child was already inside the authorized representative’s vehicle. Personnel Requirements: (k) The licensee or designated individual shall instruct all personnel to report observations or evidence of violations of any of the personal rights specified in Section 101223. 1 Per Site Supervisor, she will work with the licensee to conduct a required reporting training to all staff members. Site Sueprvisor agrees to submit proof of training materials, confirmation of attendees, and date of training to CCL-Fresno by 03/11/2024. Based on observation, the licensee did not comply with the section cited above. During the interview, it was disclosed that a staff member observed a child who was crying, upset and child disclosed that child bump child’s head. The incident was not reported to the designated individuals. It was discovered that child sustained another injury result from the fall that child bumped child’s head. This poses a potential health, safety, or personal rights risk to persons in care. 8

Site Supervisor will immediately have Staff #1 complete the transferring background clearance documentation to have Staff #1's background clearnace associate with this facility. Site Supervisor agrees to submit proof to CCL-Fresno by 03/04/204. Based on observation, the licensee did not comply with the section cited above. Based on the interview, it was disclosed that Staff #1 did not have his/her background clearance transferred to be associate with this facility.
