(d) The surface of the outdoor activity space shall be maintained: (2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. This requirement is not met as evidence by: Facility will submit a plan in writing to LPA Chancellor by COB 12/16/2023 that describes how the facility will ensure daily the health and safety of the children in care while the renovations of the playground are taking place. Director agrees to fill the holes that cause tripping hazards on the playground by COB 12/1/23 and send pictures to LPA Chancellor by 12/4/23. Based on interviews, observation and record review LPA Chancellor counted approximately nine holes and uneven terrain caused from eroded ground and loose gravel which poses a potential health, safety or personal rights risk to children in care 8
Based on record review an incident report was not provided to CCL when renovations began on the outdoor playground.
Equipment and activity areas shall be arranged so that there is no hazard from conflicting activities. C1 fell and broke arm, requring medical attention due to the uneven surfaces abruptly transitioning on the playground. which poses a potential health, safety or personal rigths risk to children in care. 1 Director will email LPA Chancellor photos of a permanent fence seperating the sand area from the grass field.
Based on interviews, the facility did not contact Emergency Medical Services when C1 had an unusual incident where C1 appeared to be choking, was unresponsive and appeared discolored.
Based on interviews and record review, staff were unable to meet the child’s needs due to failing to prevent the child from running in the class resulting in injury. This poses an immediate health and safety risk to children in care.
Personal Rights. (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication 1 Program Director agrees to conduct training on Personal Rights with all currently staff submit agenda with signatures of all staff acknowledging understanding of this regulation by 12/10/2021. or aids to physical functioning. This requirement was not met by evidence by: Staff #1,2 and 3 have been observed inappropriately handle the children-grabbing, pulling, pushing or nudging forcefully, yelling, forcing children to sleep and not providing more food when children ask for more.
