Supervision shall include visual observation. Director provided LPA with a written statement, stating the training she has provided to staff, including an updated transition procedure which staff informs the Director/front desk of their census when they are transitioning indoors/outdoors. This requirement is met as evidence by: Based on LPA’s interviews, 3 out of 3 staff stating they witnessed C1 left on playground unsupervised for about 2 minutes which poses a potential health risk to the children in care.

Based on LPA interviews and record review, S3 failed to provide supervision for the three children. The three children were able to exit the facility to the parking lot. This poses an immediate Health and Safety risk to the children in care. 8 A civil penalty of $500 was assessed today.

This requirement was not met evidence by: Director stated they will never use the infant/toddler yard again for the preschool program. The preschool children will only use their preschool yard. Based on interviews conducted, it was determined that the preschool children were playing in the infant/toddler yard. This poses a potential Health and Safety risk to the children in care.

Director provided LPA with a written statement stating facility's plan on providing training to staff on Personal Rights. Director will provide documentation with staff members name/signatures stating they were present for training. POC will be submitted to LPA by 9/29/23. This requirement is not met as evidence by: Based on LPA’s interviews and S2 admitting to placing their foot under C1’s cot a little. S1 stated S2 moved C1’s bed with their foot and lifted up C1’s bed up and down slightly. This poses an immediate risk to Health and Safety to children in care.

This requirement was not met by: 1 Director stated staff #1 (S1) is no longer working at Everbrook Academy. Director stated they conducted a staff training on Engagement and Behavior as well as Hands off. Based on LPA observation of S1 picking C1 up by the wrist/arm, dragging C1, and handling other children in care innapropriately by pulling their legs/ankles to shift them on their cots, this poses an immediate Health and Safety risk to children in care. 8

This requirement was not met: Assistant director stated staff will make sure they are supervising children by keeping them in a group all together. Head count throughout the day. More table activities to transition into other activities. Provide training on supervision. Director will submit written POC in the next 24 hours to licensing department. Based on interviews conducted, and picture provided Staff were not visually supervising C1 during circle time inside the classroom. C1 was laying on top of a stack of 13 cots without supervision. This poses potential Health and Safety risk to children in care. 8
